DAAD: Reinstatement of Driver's License
Repeat offenders face license revocation upon conviction. The courts are no longer permitted to grant restricted licenses based upon any personal hardship that might be suffered. A person whose license is revoked must request reinstatement through the Drivers Assessment and Appeal Division (DAAD) after they have reached their eligibility date. To satisfy the DAAD, a person must provide and/or prove by clear and convincing evidence the following:
- A positive alcohol evaluation,
- Show that they have stopped using alcohol (Note: ANY use of alcohol for ANY reason is considered a relapse by DAAD.) COMPLETE abstinence is required for at least 6 consecutive months, and in many cases at least 12 consecutive months.
- Successful completion of alcohol therapy (out-patient or in-patient),
- Regular attendance at a support group such as Alcoholics Anonymous (Note: Often times, DAAD wants to see that a person has obtained an AA Sponsor. The DAAD hearing officers usually quiz on the 12 steps.)
- Produce letters from family and friends showing a change in lifestyle and impact from being alcohol-free (we recommend five letters, including one from an AA sponsor), and;
- Show a reason and need to drive.
At the hearing, you bear the burden of proof. You must prove, by clear and convincing evidence, all of the following:
- That your alcohol or substance abuse problem, if any, are under control and likely to remain under control.
- That your risk of repeating past abusive behavior is a low or minimal risk.
- That your risk of repeating the act of operating a motor vehicle while impaired by, or under the influence of, alcohol or controlled substances or a combination of alcohol and a controlled substance is a low or minimal risk.
Driving on a suspended or revoked license (DWLS) or proof of driving on a suspended or revoked license (such as an abstracted ticket for "no operator's permit on person") will results in an additional term of suspension being added to the suspension period. Thus, the eligibility date is extended farther out by the Secretary of State upon conviction or proof of DWLS. For more information on Driving While License Suspended Convictions click here
